Terms of Use (EULA)

General

These Terms of Use govern your use of the Tourista mobile application. By downloading or using the app, you agree to these terms. If you do not agree, please do not use the app.

Service Description

• Tourista is a travel planning application that helps users plan trips based on attraction opening hours, distance, and travel time.
• The app may generate plans automatically or allow manual customization.
• Tourista provides suggestions only and does not guarantee accuracy or availability of attractions.

Travel Pass (Per-Trip Purchase)

• Tourista offers a one-time Travel Pass as a consumable purchase for individual trips.
• Each Travel Pass unlocks the following premium features for a single trip: (1) a more accurate plan built with real schedules and current traffic when you create it; (2) the ability to add any custom place to your plan; (3) unlimited AI help across the trip (AI Insights everywhere, plus AI Chat on the web); and (4) the smartest visit order computed for each day while you build the plan. Live data refreshes when you check or refresh your plan; the app does not push background updates and does not re-optimise during the trip.
• On the web, the price is displayed in the app and charged via Stripe at purchase confirmation. On iOS and Android, the price is shown in the app and charged via Apple or Google in-app purchase at purchase confirmation.
• A Travel Pass is tied to a specific trip plan and activates immediately upon successful payment.
• Travel Passes are not subscriptions and do not auto-renew.
• Travel Passes cannot be transferred between accounts or applied to a different trip.

Travel Pass Expiration

• A Travel Pass expires at the end of your trip. Specifically, one day after the last date in your trip plan, at 23:59 UTC.
• Once expired, the plan becomes read-only. You can still view your itinerary but premium features such as live routes and re-optimization are no longer available.
• If your Travel Pass is expired or refunded, you may purchase a new one for the same trip.

Fair Usage

• Each Travel Pass includes per-action allowances that apply for the duration of the trip. The allowances are sized well above what a normal trip uses; they exist only to prevent abuse and to keep our costs predictable.
• Most allowances are shared across all premium actions for that trip and are consumed by actions that require live data from external services (such as route calculations and place lookups). Actions that use data already stored in our system (including popular attractions and previously calculated routes) do not consume any allowance. AI Insights and AI Chat have their own separate allowances.

• Example: If you search and add 10 new places, make 30 edits, optimize 5 days, and ask 20 Place Chat questions on a Travel Pass, you will still have allowance remaining on every action.
• If you reach a limit, the app continues to work. Route times will be estimated instead of using live data, search results will be limited to places already in our database, and AI features for that category will be paused for the remainder of the trip.

Free Features

• Destination search and city browsing.
• AI-generated day-by-day itineraries based on opening hours and distances.
• Manual itinerary customization: add, remove, reorder attractions, and adjust visit durations.
• Walking route estimates between stops.
• Location insights including opening hours and status warnings.
• Premium features that require a Travel Pass: a more accurate plan built with real schedules and current traffic at creation, the ability to add any custom place, unlimited AI help (AI Insights for every day; AI Chat on the web within the per-trip allowance in the Fair Usage section), and the smartest visit order computed for each day while you build the plan.

User Responsibilities

• You must use the app for lawful purposes only.
• You are responsible for verifying travel details independently.
• Generated plans are recommendations, not guarantees.

Limitation of Liability

Tourista is not responsible for missed attractions, closures, delays, or errors in third-party data.

Governing Law and Dispute Resolution

• Tourista is operated by Avestar, registered in the Netherlands at Teakhout 38 a, 1507 EM Zaandam (KvK 42076079, BTW NL005475432B95).
• These Terms are governed by the law of the Netherlands, where Tourista is established.
• Consumers resident in the European Union, the United Kingdom, or any other jurisdiction whose mandatory consumer protection rules apply continue to benefit from those rules, even if these Terms would otherwise give weaker protection.
• EU consumers may also bring disputes to the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
• Disputes not resolved informally may be brought before the competent courts in the Netherlands, without prejudice to a consumer's right to bring proceedings in the courts of their place of residence.
